- SUBMISSION OF A PROPOSAL FOR RESOLUTION OF A CONFLICT OF COMPETENCE
Pursuant to Article 53 of the Act of the Constitutional Court of the Republic of North Macedonia,
(1) Any natural or legal person who considers that a freedom or right established under Article 110, indent 3 of the Constitution has been infringed by an individual act or action of a state authority, a body of a local self-government unit, or another entity exercising public powers, may submit a request to the Constitutional Court for its protection.
(2) The Ombudsman may also submit a request on behalf of another person.
(3) A request may be submitted once all regular and extraordinary legal remedies against the individual act have been exhausted, within 60 days from the receipt of the decision exhausting those remedies, or within 60 days from the date of becoming aware of the action, but no later than one year from the date of the action.
(4) The request must include: the name and surname, or the name if the applicant is a legal entity; the unique citizen identification number or the registration number (EMBS) for legal entities; the place of residence or temporary residence, or the registered seat of the legal entity; the name and surname of the authorised representative; details of the individual act considered to have infringed the freedoms and rights, or a description of the action by which such rights and freedoms are deemed to have been infringed; an indication of the freedoms and rights under Article 110, indent 3 of the Constitution which are alleged to have been infringed; a statement of the nature of the infringement; the signature of the applicant or the person granted specific authorisation to submit the request to the Constitutional Court.
(5) The request must also be accompanied by the challenged individual act, evidence that legal remedies have been exhausted, and any other relevant documentation for the Court’s decision-making.
