Response to the Media Regarding the Case Challenging Article 2 of the Law Amending the Law on Pension and Disability Insurance

The Constitutional Court informs the public that no final decision has been adopted in case no. U.br.13/2025 concerning Article 2 of the Law Amending the Law on Pension and Disability Insurance, which provides for an increase in pensions (publicly referred to as the linear increase).

The Court notes that at its 24th session, held on 19 November 2025, it expressed, by a majority vote, doubts as to the constitutionality of Article 2 of the Law. The proceedings are currently in the second phase, during which opinions are being sought from the enacting authority and the proponents of the Law, after which a final decision will be adopted.

The public will be informed once this case is scheduled for a session for voting.

With regard to questions as to whether the Constitutional Court has initiated proceedings in respect of all linear pension increases paid to pensioners to date, the Court informs that it will not re-examine the provisions concerning the pension increases of 2,500 denars (paid in September 2024 and March 2025). At the session held on 19 November, the Court dismissed the initiative seeking review of Articles 3 and 18 regulating that matter, on the grounds that those provisions were of a temporary nature and are no longer part of the legal order.
