On its initiative, the Constitutional Court will review the constitutionality of the Instruction amending the Instruction on keeping registry books

At their session today, the constitutional judges unanimously decided to establish a case in which a procedure will be initiated for a review of the constitutionality of the “Instructions for amending the instructions for the way of maintenance, protecting, and keeping the registry books and registers, issuing certificates, attestations, transcripts, and copies based on the registry books, conducting proceedings and filling in a record of a found child, restoration of destroyed, damaged, or missing registry books, as well as for the templates of the registry books, the register of the registry books, certificates, and attestations issued and based on the registry books”.

It refers to the Instruction that the Ministry of Justice adopted on 29 May 2023, which in recent times has significantly sparked public interest.

This case was established in accordance with the Rules of Procedure that permit the Constitutional Court to initiate a procedure for a review of the constitutionality of a law, that is, the constitutionality and legality of a regulation or other general act.

All judges attended the meeting, which was called at the request of Dobrila Kacarska, the president of the Constitutional Court.

In accordance with the Rules of Procedure, a Judge-Rapporteur and an adviser of the Court have been assigned to this case, and a preliminary procedure is already being conducted to review the constitutionality of the Instructions.

Up until the time of publication of this notice, no citizen-led initiative contesting the same Instruction had been brought to the Court due to concerns raised in a number of media outlets.
