Participation at the XIV Congress of the Conference of European Constitutional Courts
A delegation of the Constitutional Court of the Republic of Macedonia, headed
by the President of the Court, Mr. Trendafil Ivanovski, Ph.D., from 2 – 7 June
2008 participated at the XIV Congress of the Conference of European
Constitutional Courts that was held in Vilnius, ,Lithuania.
The topic of the XIVth Congress was “Problems of Legislative Omission
in Constitutional Jurisprudence” in the framework of which it was discussed
about the competence of constitutional courts and similar institutions to
assess the constitutionality of legal gaps. A General report was delivered,
which was prepared on the basis of the national reports of the constitutional
courts – members of the Conference, including the national report of the
Constitutional Court of the Republic of Macedonia. It was emphasised in the
general report that the investigation and statement of legislative omission is
a significant constitutional control measure, which helps to secure the
supremacy of the Constitution, the harmony of the legal system and better
protection of constitutional rights and freedoms of an individual. The
discussion of the participants of the Congress revealed a great variety of
constitutional jurisprudence related with investigation of the
constitutionality of legal gaps. Most of representatives of the Constitutional
courts participating in the debate, emphasized that the investigation of
legislative omission is a significant aspect of securing the constitutionality
of law.
Delegations from 39 European states – full members of the Conference,
observers from states of Europe, Central and South America, Asia and Africa,
representatives of the European Court of Human Rights, European Court of
Justice and the European Commission for Democracy through Law (the “Venice
Commission”) participated at the XIV Congress.
At the meeting of the Circle of Presidents of the Conference, the
Supreme Court of the Principality of Monaco was admitted as a full member of
the Conference. It was also decided to organise the next, XV Congress of the
Conference of European Constitutional Courts in 2011 in Bucharest, Romania.
